Plaintiff tripped and fell from defendant?s commuter airplane. The stairs of defendant's plane had a handle protruding upwards into the walkway. As plaintiff proceeded down the stairs the stewardess distracted his attention by calling out to him. .
Plaintiff's Contentions, Allegations:
Plaintiff contended defendant's stairs constituted a dangerous condition and that the flight attendant was negligent in distracting plaintiff's attention.
Injuries and/or Damages: Plaintiff suffered injuries to his back. Plaintiff had disc bulges at L4/S, L5/S1.
Defense:
Defendant's stairway was not dangerous because there had been no prior accidents. Plaintiff's condition pre-existed.
